Acceptance of Terms of Use

The following forms a legal agreement between you and Baldwin Lewis Interiors DBA Loved The Party.com. By using this site you are acknowledging that you have read, understood, and agree to be bound by these terms, policies and all applicable laws and regulations. If you do not agree to these terms please do not use this site. The material provided on this site is protected by law, but not limited to, United States Copyright Law. Any claim relating to the use of this site, its material and any sales there under is governed by the laws of the state of Texas, without regard to conflict of laws and rules, Texas will be the sole jurisdiction and venue for any litigation arising from use of or orders made on this site.

Shipping Time

Please allow 5 to 10 business days to receive your order unless otherwise noted.

Use Restrictions

Except as stated herein, none of the material on www.lovedtheparty.com may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means including, but not limited to to, electronic, mechanical, photocopying, recording, or otherwise without the prior written premission of Baldwin Lewis Interiors. You also can not "mirror" any material contained on this site. Any unauthorized use of any material contained on this site may violate copyright laws, trademark laws, and various other regulations and statutes.

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Loved The Party.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or PayPal account charged. If your credit card or PayPal account has already been charges for the purchase and your order is canceled by us, Loved The Party shall immediately issue a credit to your credit card or PayPal account in the amount of the charge. The display of products in this site shall not constitute as offer to sell.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it consititute confirmation of our offer to sell. Loved The Party.com reserves the right at any time after receipt of your order to accept or decline your order for any reason.

Sales and Use Tax

Loved The Party.com witholds sales tax (8.25%) for orders to be delivered to addresses within the state of Texas. Each customer shall be solely responsible for all sales and/or use taxes on orders shipped to any other location.

Titles; Risk of Loss

Title of products shipped passes from Loved The Party.com to you on the date of shipment from us.

Links provided on this site to third party sites are provided as a convenience to you and the provision of  a link to a third party site does not constitute an endorsement by Loved The Party.com of such third party site or its provider or any of the contents, products or services contained or offered in such third party site. We are not responsible for the terms, policies or practices or the content of any third site.

Disclaimer and Limitation of Liability as to Products Sold

All of Loved The Party.com products are guaranteed against defects for 30 days from the date of the invoice. Except as expressly stated herein, Loved The Party.com makes no representation or warranties, either or implied, of any kind with respect to products sold on the Loved The Party.com site. Except as expressly stated herein, Loved The Party.com expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Loved The Party.com arising from any product sold on the Loved The Party.com site shall be the price of the item ordered. Product Packaging & Item Description

Packaging

All of our items are shipped in the original manufacturer packing. We pack each item carefully, and most items come individually wrapped in its own gift box.

Sizes

Sizes of products are approximate. Sizes of clothing are within industry standards. Handcrafted items, by their very nature will vary from piece to piece unlike manufactured goods. While we try quite hard to give exact measurements, manufacturers sometimes slightly change the sizes of products. If the size is close in proximity to the size listed on our website, we do not deem the item to be defective or incorrect. Should the size variance be significantly different we will gladly accomidate any refund, return or replacements.

Product Description

Every attept is made to provide you with accurate product descriptions, colors and sizes. Due to variances in color settings on different types of monitors, colors of actual products may differ slightly from the image you see on our website.

We have used our reasonable efforts to display as accurately as possible the colors of the materials shown on this site. However, because the colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. We apologize for any inconvenience this may cause you.

Out Of Stock Policy

Every effort is made to keep items in stock, however, during busy wedding seasons, holidays, the ocassional baby boom, some items may go out of stock for short periods of time.

On occasion, products may be backordered which will be noted in the product description**, with an expected in stock date. If a product is backordered, you are welcome to place an order, but please note, your order will not ship until it comes back in stock in our inventory. If you place an order for backorder stock, your credit card or PayPal account will be charged at the time of the order. Pre-paid out of stock orders will be guranteed to be shipped as soon as the itmes come back into inventory.

On products that are noted as out of stock and ordered via our website, we will still follow our normal procedure of authorzing and billing our credit card or PayPal account, however we will also notify you via email that the merchandise is out of stock and give you an estimated date in which we will expect our shipment to arrive.

If an order is placed which is on backorder status, your credit card or PayPal account will be charged at the time the order is placed. This will ensure that we reserve the merchandise for you. All pre-paid backorders will have priority stock versus non-paid backorders.

Occasionally, items may go out of stock without notice and we may not have adequate lead time to update our website. If this occurs, and you place an order on a product which has just gone out of stock, we will notify you via email of the out of stock status and expected delivery date.

You will then have the option to change your order, cancel your order or place the item on backorder status.

Product Service and Support

All requests for technical services and support for products should be made directly to the manufacturer in accordance with their terms and conditions.

Cancellation Of Order

Orders not yet processed can be cancelled, however unless you SPEAK WITH US DIRECTLY on the phone the chance of getting the order cancelled before processing is decreased.

Any personalized, monogrammed or engraved items cannot be cancelled or refunded once your order has been processed. 

Return Policy

We trust that you will be pleased with your order, however if you need to return an item please note the following:

Contact us first for returns. All returns and exchanges must have a Return Authorization number posted clearly on the outside of the return package or box. To obtain an RA number, please email us at info@LovedTheParty.com. We will provide you with an RA number and our return address. No returns will be processed without an RA number.

No refund on items that were damaged during transit back to us. Please carfeully pack your parcel back to us, as we will not be able to offer you credit on any merchandise which was damaged in return transit.

The following items may not be returned: customized orders, personalized orders, engraved products, edible and confectionery merchandise, wearables which have been worn or that are personalized, (i.e. - baby/childrens clothes, blankets, garters, dressups, jewelry, or other textiles), consumables  (wedding bubbles, candles, lotions, flowers, rose pedals), cameras, closeouts/clearance and partial item returns.

You may return new, unopened items in their original package within 14 days of invoice for refund minus shipping unless otherwise noted in description of item. 14 to 30 day returns may require restocking fee, please contact us for information regarding restocking fees.. 

Damage Policy

We pack each shipment carefully, but sometimes a shipment might arrive damaged. If something should arrive damaged, we will issue you a credit or send you replacements, but please allow enough time to receive the replacements via UPS Ground

We reserve the right to issue a UPS call tag for merchandise return so that we may inspect the damage and process a claim with UPS. The call tag will be issued at not cost to you.

All claims must be made within 7 days of receipt of merchandise. No claims will be accepted ager 7 days.

Refused Delivery

Any orders refused for delivery by a customer without prior cancellation notice to us and confirmation by us of your order cancellation, will be subjected to a 25% re-stocking fee.

Please see our cancellation policy above if you wish to cancel your order.

Undeliverable Packages

Customer will be charged a $25.00 additional handling fee for any undeliverable shipment due to customer's incorrect address entered on the order form which must be reshipped.

Any shipment that needs to be re-shipped will be charged the same shipping charges that applied to the original order plus a $25.00 handling fee.

Please note: UPS does NOT deliver to P.O. Box addresses.
